Delaware Learner’s Permit vs. Intermediate License

Delaware's Graduated Driver Licensing (GDL) program is structured to help new drivers, especially teens, gain experience under less risky conditions. The program consists of three stages: the Level One Learner’s Permit, the Intermediate License, and the full Class D License. Level One Learner’s Permit

Eligibility and Requirements

  • Age: Must be at least 16 years old.
  • Driver Education: Completion of a state-approved driver education course is mandatory. This includes 30 hours of classroom instruction, 7 hours of in-car observation, and 7 hours of behind-the-wheel training.
  • Documentation: Applicants must provide proof of identity, legal presence, Social Security number (if eligible), and two proofs of Delaware residency. If the sponsor is a licensed Delaware driver residing at the same address, the residency requirement may be waived.
  • Sponsor: A parent, legal guardian, or other approved adult must sign the application, assuming joint liability for the minor's driving.
  • Fee: A $40.00 application fee is required.
  • Vision Test: Must pass a vision screening test.

Restrictions

  • First 6 Months:

    • Driving is permitted only when accompanied by a qualified supervisor who is at least 25 years old, has held a Class D license for at least 5 years, and is approved by the sponsor.
    • The supervisor must occupy the front passenger seat.
    • No other passengers are allowed in the front seat.
    • All occupants must wear seat belts or appropriate child restraints.
    • Use of mobile phones or electronic devices while driving is prohibited.
    • A minimum of 50 hours of supervised driving, including 10 hours at night, must be logged.
  • Second 6 Months:

    • Unsupervised driving is allowed between 6:00 AM and 10:00 PM.
    • Supervised driving is required between 10:00 PM and 6:00 AM, except when traveling to or from church, work, or school activities.
    • Only one passenger is allowed in the vehicle unless accompanied by a supervisor or transporting immediate family members.

Duration

The Level One Learner’s Permit is valid for 12 months. Any suspension or revocation extends the permit period accordingly.

Intermediate License

In Delaware, the Intermediate License phase is integrated into the second six months of the Level One Learner’s Permit. After successfully completing the 12-month permit period without any suspensions or revocations, the permit automatically transitions to a full Class D License.

Transition to Full Class D License

  • Age Requirement: Must be at least 17 years old.
  • Completion of Permit Period: Must have held the Level One Learner’s Permit for 12 months with no suspensions or revocations.
  • Automatic Upgrade: The license automatically becomes a full Class D License on the effective date printed on the license, provided all conditions are met.
